OBTAINING APPROVAL
Do you want to work in Romania? You need to find an employer and take the tests they require. If they decide to hire you, they will give you an employment permit. You can be employed in Romania with one employer, natural or legal person and in one position (COR code). A foreign citizen who transfers from one company to another in Romania must obtain a new work permit.
The application for the issuance of the employment/departure permit is submitted by the employer/beneficiary of the service provision to any of the territorial units of the General Inspectorate for Immigration. The documentation required to obtain the employment/detachment permit may be submitted by any person who is a legal representative of the employer/beneficiary of the service, in accordance with the law.
Conditions for obtaining the opinion
When submitting the application for the issue of the employment/departure notice, the employer/beneficiary of the service will pay as follows:
- for the employment permit for permanent, seconded, cross-border, trainee, highly qualified, au pair worker, the employer will pay the equivalent in lei of 100 euro;
- for the work permit for a seasonal worker, the employer will pay the equivalent in lei of 25 euros;
- the equivalent in lei of 25 euro in case the employer intends to employ a foreigner holding the right of temporary residence for studies after graduation or for the holder of the right of temporary residence for family reunification, as well as in case of change of employer or position with the same employer;
The receipt must be presented in original, signed and stamped by the treasury unit. If the fee for issuing the employment/departure permit is not paid to the treasury, the State Treasury units will confirm, by signature and stamp, the collection of the respective sums in the corresponding revenue accounts of the state budget.
In case of refusal to issue the employment/departure notice, the employer/beneficiary of the service provider shall recover the fee paid, according to the law.
If you do not have Romanian citizenship or the citizenship of another member state of the European Union, the European Economic Area or the Swiss Confederation, you can work in Romania, with an employment permit, if the following conditions are met:
- Job vacancies cannot be filled by Romanian citizens, citizens of EU/EEA member states or permanent residents on Romanian territory;
- Meet special requirements for professional training, work experience and licensing;
- Prove that you are medically fit to carry out the activity;
- You have no criminal record that is incompatible with the activity that you carry out or are going to carry out on the territory of Romania;
- It will fall within the annual quota approved by Government Decision;
- The employer is up to date with its obligations to the state budget;
- The employer carries out activities compatible with the position for which the foreign national is seeking employment;
- The employer/service provider must not have been sanctioned for undeclared work or illegal employment in the last 6 months prior to the application for permanent/seasonal/trainee/transfrontier/highly qualified/au pair/detached/ICT workers.
Depending on the type of activity, there are several types of work permits:
- Employment notice for permanent workers- foreigners employed on the Romanian territory with an individual employment contract for an indefinite period or for a fixed period, concluded with an employer on the basis of the employment notice.
- Employment notice for seconded workers- qualified foreigners, temporarily seconded from the enterprise established in a third country, where they are and remain employed with a valid employment contract, to a beneficiary of the provision of services belonging to the same enterprise or group of enterprises as the enterprise from which the secondment is made or with which the enterprise has concluded a contract involving the secondment of one of its employees on the territory of Romania.
- Employment notice for highly qualified workers- foreigners employed in Romania in a highly qualified job, with an individual employment contract for an indefinite period or for a fixed period of at least one year, concluded with an employer on the basis of an employment permit;
- Employment notice for ICT workers(intra-corporate transferees) - foreigners living in a third country at the time of the application for the secondment notice who are subject to an intra-corporate transfer.
Other types of work permits that can be granted to foreign citizens are: work permits for au pairs, seasonal workers, trainees and cross-border workers.
The General Inspectorate for Immigration shall settle the application for issuing the employment permit within 30 days from the date of registration. In cases where additional checks are necessary, the deadline may be extended by a maximum of 15 days.
After obtaining the work permit, the employer must send this document to the foreign citizen, and the foreign citizen will have to obtain a long-stay visa for employment from the diplomatic missions or consular offices of Romania.
